PoliciesThis Agreement is an agreement between you and A&A Produce On The Go. It states the terms and conditions under which you may use the website and receive the A&A Produce On The Go service. It also includes the process of how to order and pay for your produce and the terms of delivery. Special terms are contained at the end of this Agreement. The Special Terms supersede all other terms of the agreement even in the event they are different, inconsistent or add to any other terms. The fact that you use this website constitutes your agreement to all the terms and conditions within this document. If you do not agree with all of the terms and conditions, do not use this website or the service of A&A Produce On The Go. The agreement will remain in full force and effect until terminated. TERMS OF THIS AGREEMENT:
This Agreement begins when you accept the terms and conditions in this document by entering the website of A&A Produce On The Go and entering the information necessary to place an order. A&A Produce On The Go may suspend or terminate this Agreement, or the A&A Produce On The Go Service, or remove or disable access to any portion of the A&A Produce On The Go Service at any time for any reason with or without notice to you.
You may terminate this Agreement and your A&A Produce On The Go Service at any time for any reason by giving written notice via email or through the postal service. The termination will be effective the day notice is received or such later date specified in the notice.
A&A Produce On The Go reserves the right to collect fees and charges incurred before or after you cancel your A&A Produce On The Go Account.
NOTICES.
A&A Produce On The Go may give notice to you of a change in this Agreement, a change in the availability of product or product pricing through a general posting on the website, through email or through conventional United States Postal Service to your address that was supplied by you on the Customer Registration Form.
A&A Produce On The Go may require the return of the product you are dissatisfied with to our warehouse facility located at 4726 Northgate Boulevard, Myrtle Beach, South Carolina between our regular office hours before we substitute an acceptable item or issue a credit voucher.
THINGS HAPPEN. A&A Produce On The Go strives to fill every order to perfection. However, we are not selling metals screws or canned food. The availability, quality and pricing of fresh produce depends on many factors often beyond our control. An early frost or a flood may damage or pose a threat to produce crops causing prices to skyrocket in a matter of hours. Long distance trucks traveling cross-country get in accidents and have breakdowns. If a load sits three days in the hot desert while a truck or refrigeration unit is getting repaired we very likely will reject the order upon inspection.
Fresh produce begins to deteriorate from the time it is harvested. The rate of deterioration may depend on several factors including and not limited to the weather in the days prior to harvesting, the temperature the product was placed under refrigeration, the temperature the produce was maintained during transport and delays in transportation time to our facility.
Fresh produce is both ordered and delivered to our warehouse daily from around the country. It is a perishable commodity. From time to time we may find it necessary to refuse a delivery truck or a portion of a scheduled delivery truck due to market conditions and/or products not passing our quality standard.
It is our goal to always fill orders at 100% however there may be times when we do not have a particular item in stock due to market conditions or other events beyond our control. A similar item may be substituted. We will try to contact you prior to making a substitution. If you are not satisfied with the substitution please contact us immediately.
We reserve the right to limit qualities.
We are a full-service fresh produce company. We can usually find anything you want at any time of the year in any quantity needed. Please fill free to contact us concerning any special orders or to discuss your desires with one of our managers. We have skilled managers with years of culinary and wholesale food experience that will be happy to make suggestions for your produce items for special events.
ERRORS IN PRICING: We are human beings and we are capable of making mistakes. We take responsibility and will admit to a price being keyed in incorrectly and will do our best to correct it as soon as we are aware of it. Your price is guaranteed at checkout unless you placed an order for an item where we entered an incorrect price. Should that occur, we reserve the right to cancel undelivered orders for such incorrectly priced products. We will attempt to contact you immediately in such circumstances to see if you want the item at the corrected price. Your credit card or checking account will not be charged.
A&A Produce On The Go uses refrigerated trucks to maintain the quality and integrity of your products. To maintain the quality of products after delivery, we have a custom-designed insulated box that is capable of keeping your order fresh at room temperature (75 degrees) for up to six (6) hours from the time of delivery.
Delivery Schedules: There are designated delivery times. You or someone you choose to take custody of your order is responsible for picking up the order in a timely manner. Anyone you designate to receive your order must have your invoice number that can only be supplied by you. Depending upon the amount of boxes delivered to a website our driver should be onsite no longer than 30 minutes and may be onsite fewer than 10 minutes. At the end of the delivery time we will consider the boxes delivered whether or not they are picked up. The boxes will be left on the premises designated on your order and your charge card will be billed 100% of the total dollar amount. A&A On The Go will not be responsible for the safety or quality of the product after leaving the premises.
In order to remain on a scheduled delivery to customers, time may not permit the driver to remain on the premises for an inspection of your delivered boxes. Should anything be incorrect or missing from an order when checked against the delivered receipt please call 1-843-294-AAGO (2246) or log on and contact us via e-mail.
Should circumstances arise beyond our control causing delays or changes in delivery schedules it may be necessary to change our delivery schedule. We will make every effort to notify you as soon as possible of any changes in the schedule and deliver your order as soon as possible.
A&A Produce On The Go drivers are allowed to accept tips. Customers are under no obligation to tip drivers but have the option of doing so if exceptional service is provided by the driver.
There must be a valid debit or credit card on file in your Customer Account Information prior to an order being filled.
On the day of your delivery your debit or credit card will be charged. Should we encounter problems during the transaction of processing your card we will make an effort to contact you. Should there be a problem that causes us to be unable to process your card to pay your invoice, A&A Produce On The Go deems the invoiced amount is due and payable and reserves the right to collect funds for any uncollected transactions owed.
It is time consuming to reprocess credit and debit cards. Should any form of payment be declined requiring another form of payment A&A On The Go reserves the right to charge up to $3.00 per order.
Upon the failure to pay any charges or fees when due, including a check being returned or electronic payment being rejected, A&A Produce On The Go may charge the amount directly to the credit card identified in your Customer Account Information.
A&A Produce On The Go reserves the right to suspend or terminate your access to the A&A Produce On The Go Service until your account is paid in full. You, the customer, will be responsible and liable for any fees including collections and/or attorneys' fees that A&A Produce On The Go may incur in its efforts to collect any unpaid balances from you.
Your right to use the A&A Produce On The Go Service is subject to limits established by A&A Produce On The Go and/or by your bank, credit or debit card.
A&A Produce On The Go reserves the right to withdraw a payment option from any account for any reason at any time.
Failure to pay any charges or fees when due, including a redelivery or restocking fee, may result in A&A Produce On The Go charging the amount directly to the charge or debit card in your Customer Account.
Failure to pay any charges or fees when due may result in the suspension or termination of your account with A&A Produce On The Go.
You are responsible and liable for any fees, including attorneys' fees and collection costs, that A&A Produce On The Go may incur in its efforts to collect any unpaid balances on your account.
Third-Party Information Providers and Merchants: A&A Produce On The Go and its affiliate companies are part of a large personal networking system. There may be times when we recommend people we know and/or companies and services we use. These companies are not owned by A&A Produce On The Go or its affiliates but are simply companies we may introduce to our customers.
You are agreeing that any business you may conduct with any third-party recommended by A&A Produce On The Go is completely between you and the third party and is no way guaranteed by A&A Produce On The Go. Any transactions you may enter into with a third-party will be covered under the third-party's policies and customer agreement.
Copyright and Ownership. Everything on the A&A Produce On The Go website is the property of and duly licensed to A&A Produce On The Go. Anyone may copy and print portions of A&A Produce On The Go website for the purposes of promoting A&A Produce On The Go to potential customers or for the purposes of understanding A&A Produce On The Go policies and procedures and/or to become a customer and/or for the purposes of placing orders. A&A Produce On The Go along with Third-party authors or owners remain the owners. No one will gain any ownership interest by using, reading, photocopying or downloading any portion of the website.
Trademarks. A&A Produce On The Go logos may not be used by you or anyone for any reason other than as allowed by this Agreement.
You must have reached the age of majority in order to enter into this legally binding Agreement and you will be responsible for all your activities on the A&A Produce On The Go website and with all the terms of this agreement.
Any fees for internet or telephone services and connections required to access the website are your responsibility.
It is understood that occasionally the service to this website may be inoperable due to maintenance, repairs or malfunctions.
ID Number and Passwords:Upon registration you will have access to the A&A Produce On The Go Service through a user name and password that you choose on the website. You are solely responsible for any authorized or unauthorized access to your account by any person. You agree to bear all responsibility for the safekeeping and confidentiality of your password and any and all charges incurred from use of your password on the A&A Produce On The Go website. You agree to notify A&A Produce On The Go promptly of any unauthorized use of your password and you will remain liable for any use, charges and/or fees associated until you notify A&A Produce On The Go of the unauthorized use of your password.
Your Account: You are responsible for all charges to your account, including applicable taxes and purchases by you or anyone you allow to use your account and password to access the A&A Produce On The Go Service. You agree and accept responsibility for keeping all your account information current, including address, payment information, telephone number and e-mail address. You can update your information in the "My Account" area on our website or contact our Customer Service department.
You agree that you will not provide fraudulent information and that you are solely responsible for any information you provide to A&A Produce On The Go. You also agree that you accept responsibility for all activities that occur under your account or password. You will comply with all laws applicable to your activities on the website and with this Agreement.
A&A Produce On The Go's secure server encrypts your payment information so that it cannot be read as the information travels over the Internet. Once we receive your payment information, it is stored in our secure data center. A&A Produce On The Go will exercise reasonable efforts to ensure that your payment information remains confidential, and is available only to personnel who have a need to know such information in connection with providing you the A&A Produce On The Go Service.
Sensitive and personal information such as credit card numbers, physical and/or email addresses is protected and encrypted with encryption software. Our website encrypts your credit card and bank account number prior to transmission over the Internet using secure socket layer (SSL) encryption technology.
Corrections:You may update or correct information previously provided to us by updating your account information yourself by going to Your Account on the A&A Produce On The Go website.
Do not give out your account or password information because you are totally responsible for anything that occurs under your password and account.

A&A PRODUCE ON THE GO DOES NOT PROVIDE ANY REPRESENTATION OR WARRANTY OF ANY MANUFACTURER OR MERCHANT OF ANY INFORMATION, SERVICE, OR PRODUCTS. A&A PRODUCE ON THE GO MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND AS TO THE AVAILABILITY, ACCURACY, OR CONTENT OF ANY INFORMATION, SERVICES, OR PRODUCTS OBTAINED THROUGH THE WEBSITE OR THE A&A PRODUCE ON THE GO SERVICES. A&A PRODUCE ON THE GO DOES NOT WARRANT THAT THE FUNCTIONS PROVIDED BY THE WEBSITE WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT THIS WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE IS FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
